Permits are issued under the following conditions:
1. Permit is issued to a competent adult.
2. Prior to commencement of open burning, the fire department shall be notified.

3. Open burning shall not be conducted within 50 feet of any structure or other combustible material. Conditions which could cause the fire to spread to 50 feet of any structure shall be eliminated prior to ignition.

EXCEPTION: Clearance from the structures and other combustible materials is allowed to be reduced as follows:

A. Not less tha 15 feet when burning is conducted in an approved burning appliance.

B. Not less that 25 feet when the pile size is 3 feet or less in diameter and 2 feet or less in height.

4. A garden hose connected to a- water supply or other approved fire extinguishing equipment shall be readily available for use at the open burning site.
5. Burning material shall be constantly attended by a person knowledgeable in the use of the fire extinguishing equipment required and familiar with the permit limitations which restrict open burning. An attendant shall supervise the burning material until the fire has been extinguished.
6. The fire department is authorized to require that the open burning be immediately discontinued if the fire department determines that the smoke emissions are offensive to occupants of surrounding property or if the open burning is determined by the fire department to constitute a hazardous condition.
7. Burning activities shall be conducted between the hours of 6:00 a.m. to 6:00p.m. only.
